Residence Permit Refused in Hungary? Don’t Wait Until It’s Too Late

A residence permit application is usually about much more than a few documents.
Maybe you have been accepted by a Hungarian university. You may already be planning where to live and when to arrive.
Maybe you found a job, want to start a business, or plan to join your family in Hungary.
Or maybe you already live here. You study, work, rent a home and have built your life in Hungary. You only applied to extend your existing residence permit.
Then the decision arrives.
Your application has been refused.
Suddenly, your plans are replaced by very different questions.
What happens now? Do I still have options? What should I do? And how much time do I have?
A refusal does not always mean the end
Depending on the type of procedure and the decision, you may have a legal remedy against the refusal.
But this does not mean that the same solution works in every case.
It matters what type of residence permit you applied for. It matters whether this was your first application or an extension of an existing permit.
Most importantly, it matters why the authority refused your application.
This is why the first step is not simply to start writing an appeal.
First, you need to understand the case.
And the clock may already be running
Deadlines in immigration cases can be very short. In many cases, there may be only 8 days to submit an appeal.
Eight days may sound like enough time.
It often isn't.
The refusal decision needs to be reviewed. But sometimes that is only the beginning.
The original application, supporting documents, any request for additional documents and previous communication with the immigration authority may also need to be checked.
You need to understand why the application was refused and whether there is a legal basis to challenge the decision.
If an appeal is possible, there is still more work to do. The appeal must be prepared, the relevant documents must be collected, and everything must be submitted before the deadline.
Eight days can quickly become seven, five or three.
Some people ask for help on the same day they receive the refusal.
Others start looking for help on day seven.
The decision may be similar.
The time available to deal with it is not.

Are you outside Hungary or already living here?
This can make a major difference.
If you are abroad and your first residence permit application has been refused, your situation is very different from someone who already lives in Hungary.
If the authority refused an application to extend an existing residence permit, the decision may also affect the person's current stay in Hungary.
This is why another person's story on the internet usually cannot tell you what will happen in your own case.
The residence permit may be the same. The authority may be the same. Even the reason for refusal may look similar.
The case behind it can still be completely different.
What if your appeal was also refused?
Sometimes the document in front of you is not the first negative decision.
Maybe you already appealed against the first decision. Now the second decision has arrived.
And it is another refusal.
At this stage, the case is different. Depending on the circumstances, judicial review before a court may be possible.
But now the full history of the case becomes important: the original application, the first decision, the appeal and the second decision.
Again, time matters.
The last day before a deadline is not a great time to start finding out what happened during the previous months.
What should you do after receiving a refusal?
First, check exactly what decision you received, when it was delivered and what it says about your legal remedies and deadlines.
Then collect the documents connected to your case. Do not keep only the refusal. The documents you submitted earlier may also be important.
Before deciding whether an appeal, a new application or another legal step makes sense, one question needs to be answered: Why was the application refused?
A refusal does not always tell you how your case will end.
But there is one thing worth remembering from day one: The legal deadline does not start when you find a lawyer.
And day eight is a particularly bad day to open the case file for the first time.
